These Terms & Conditions apply to consumer orders placed through the Sweyn Forkbeard Website. Wholesale, trade or other business-to-business purchases may be subject to separate terms.
Please read these Terms & Conditions carefully before placing an order. By placing an order through our Website, you agree to be bound by these Terms & Conditions together with our Privacy Policy, Shipping Policy and Return & Refund Policy.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
2. Using Our Website
You may use this Website only for lawful purposes.
You must not misuse the Website, attempt to gain unauthorised access to it, introduce viruses or other harmful material, or interfere with its normal operation.
We make reasonable efforts to ensure that information on our Website is accurate and that the Website remains available. However, we cannot guarantee that the Website will always be uninterrupted or completely free from technical errors.
3. Product Information
We make reasonable efforts to describe and photograph our products accurately.
Product photographs are for illustrative purposes. Colours may vary slightly because of lighting, photography, screen settings, natural variations in ingredients or materials, and manufacturing batches.
Measurements, weights, packaging, specifications, ingredients and product presentation may occasionally change without prior notice where this does not materially affect the nature or quality of the product.
Where ingredients or other information printed on the physical product packaging differs from information previously displayed on our Website, customers should refer to the information supplied with the product.
If you have allergies, sensitivities or particular ingredient requirements, please review the product information carefully before use and contact us if you require further information.
Products should always be used in accordance with their instructions and for their intended purpose.
4. Age-Restricted Products

5. Placing an Order
When you submit an order through our Website, you are offering to purchase the products shown in your order.
You are responsible for ensuring that the information you provide, including your name, billing address, delivery address, email address and payment details, is accurate and complete.
After placing your order, you will receive an Order Confirmation email confirming the details of your purchase.
Our acceptance of your order takes place when we send you the Order Confirmation email, at which point a contract is formed between you and Futuglobe Ltd.
We reserve the right to refuse or cancel an order before acceptance where, for example, a product is unavailable, a pricing or description error has occurred, payment has not been authorised, fraud is suspected, an age-restricted purchase cannot be verified, or we cannot lawfully supply the product to the requested destination.
If we cancel an order after taking payment, we will refund the relevant amount.
6. Availability
All orders are subject to product availability.
Placing an item in your shopping cart does not reserve it.
If a product becomes unavailable after you place an order, we will contact you as soon as reasonably possible and offer an appropriate alternative where available or provide a refund for the unavailable item.
7. Prices, UK VAT and International Orders
All prices are displayed in Pounds Sterling (GBP) unless otherwise stated.
The principal UK consumer prices displayed on our Website include applicable UK VAT.
For customers with a UK delivery address, applicable UK VAT is included in the final product price. Standard UK delivery is currently free unless otherwise clearly stated before the customer places the order.
For qualifying orders being exported from Great Britain to destinations outside the United Kingdom, UK VAT may be removed when the delivery destination is confirmed during checkout, subject to applicable VAT rules and export requirements.
Where UK VAT is not charged on an international order, this does not mean that the order is necessarily free of all taxes.
International customers may be required to pay local VAT, import VAT, customs duties, handling charges or other taxes imposed by the destination country. Unless we expressly state that such charges have been collected by us at checkout, these charges are the responsibility of the customer.
International shipping charges are calculated according to the delivery destination and are displayed during checkout before payment is completed.
We reserve the right to change prices at any time. Price changes will not affect orders that we have already accepted.
8. Pricing Errors
We take reasonable care to ensure that prices displayed on our Website are correct.
If we discover an obvious pricing error before accepting your order, we are not obliged to supply the product at the incorrect price.
Where appropriate, we will contact you and give you the opportunity to purchase the product at the correct price or cancel the order.
If payment has already been taken for an order that we subsequently cancel because of a pricing error, the amount paid will be refunded.
9. Promotions, Discounts and Gift Cards
Promotional codes, discount offers and special promotions are subject to any additional conditions stated with the relevant promotion.
Unless otherwise stated, promotional codes cannot be exchanged for cash and may not be used in conjunction with another promotional offer.
We reserve the right to withdraw or amend a promotion before an order is placed where reasonably necessary.
Gift cards are subject to any additional conditions displayed on the relevant Gift Card product page at the time of purchase.
Your statutory rights are not affected by promotional or Gift Card conditions.
10. Payment
Payment may be made using the payment methods displayed during checkout, which may include debit or credit card, PayPal, Stripe or other payment methods supported by our checkout provider.
Payment processing is handled through secure third-party payment providers.
We do not ask customers to send payment card information to us by email. Please never send credit or debit card details by email.
Where a payment is refused, reversed, cancelled or identified as potentially fraudulent, we may suspend or cancel the relevant order.
Refunds will normally be made to the original method of payment unless otherwise agreed or required by law.
11. Delivery
Current delivery methods, estimated delivery times and shipping charges are set out in our Shipping Policy and during checkout.
We normally aim to process and dispatch orders promptly, but delivery dates are estimates unless we expressly agree a guaranteed delivery date with you.
Unless another delivery period has been agreed, goods will be delivered without undue delay and normally within 30 days after the contract is formed.
We are not responsible for delays caused by customs authorities, carriers, severe weather, industrial action or other circumstances outside our reasonable control, although your statutory rights relating to delayed or failed delivery remain unaffected.
Please ensure that your delivery address is complete and accurate. We are not responsible for additional costs resulting from an incorrect address supplied by the customer where the error is not ours.
12. Risk and Ownership
We remain responsible for the goods until they are delivered into your physical possession or the physical possession of a person you have identified to receive them on your behalf.
Ownership of the goods passes to you once we have received full payment and the goods have been delivered.
13. International Delivery and Customs
Customers ordering products for delivery outside the United Kingdom are responsible for ensuring that the products may lawfully be imported, possessed and used in the destination country.
Customs rules vary between countries.
International parcels may be opened, inspected or delayed by customs or border authorities.
The recipient may be required to provide information requested by customs authorities or the delivery carrier in order for the parcel to clear customs.
Unless expressly stated otherwise at checkout, any import VAT, local taxes, customs duties, brokerage fees or similar destination-country charges are the responsibility of the customer.
If an international parcel is returned to us because the customer refused or failed to pay applicable import charges, failed to provide information required by customs, or failed to collect the parcel, we may deduct reasonable and unrecoverable outbound shipping, return shipping, customs or carrier charges from any refund, to the extent permitted by law.
This does not affect rights that cannot legally be excluded.
14. Cancelling an Online Order – 14-Day Cooling-Off Period
For most consumer purchases made online, you have the right to change your mind and cancel the contract without giving a reason.
The cancellation period normally ends 14 days after the day on which you, or a person nominated by you other than the carrier, receives the goods.
If a single order is delivered in separate parcels on different days, the cancellation period normally runs from receipt of the final parcel.
To exercise your cancellation right, you must clearly inform us of your decision before the cancellation period expires.

You may use the Model Cancellation Form at the end of these Terms, but you do not have to use that form. Any clear statement informing us that you wish to cancel is sufficient.
15. Exceptions to the Cooling-Off Right
The statutory cooling-off right does not apply in certain circumstances.
This includes goods made to your specifications or clearly personalised for you.
It may also include goods supplied in sealed packaging that are not suitable for return for health protection or hygiene reasons once the seal has been broken after delivery.
This may apply to certain sealed grooming, cosmetic or toiletry products where, because of their nature, they cannot safely or hygienically be resold once unsealed.
The hygiene exception does not affect your rights where a product is faulty, damaged, not as described or otherwise does not conform to the contract.
16. Returning Goods After Cancellation
After telling us that you wish to cancel, you must normally return the goods within 14 days.
Please contact us before returning an item so that we can provide the appropriate return instructions. Requiring you to contact us for instructions does not remove or restrict your statutory cancellation rights.
Unless the goods are faulty, incorrect or we have agreed otherwise, you are responsible for the direct cost of returning goods following a change-of-mind cancellation.
You must take reasonable care of the products while they are in your possession.
You may inspect products to the extent reasonably necessary to establish their nature, characteristics and functionality, in a similar way to how you could reasonably inspect them in a shop.
We may make a reasonable deduction from a refund where the value of goods has been reduced because they have been handled beyond what is reasonably necessary to inspect them.
Products should be returned securely packaged to reduce the risk of damage in transit.
We recommend obtaining proof of postage or using a tracked return service.
17. Refunds Following Cancellation
Where you validly exercise a statutory cancellation right, we will refund the amount required by applicable law.
This will normally include the price paid for the cancelled goods and, where applicable, the cost of our least expensive standard outbound delivery option.
If you selected a premium or express delivery service, we are not required to refund the additional amount above the cost of our standard delivery service.
For returned goods, we may withhold the refund until we have received the goods back or you provide satisfactory evidence that you have sent them back, whichever occurs first.
Refunds will normally be made without undue delay and no later than 14 days after the relevant refund obligation arises.
Refunds will normally be made using the same payment method used for the original transaction unless otherwise agreed.
18. Faulty, Damaged or Misdescribed Goods
All goods supplied by us must meet your statutory consumer rights.
Goods must be of satisfactory quality, fit for any purpose made known to us where applicable, and match their description.

Under applicable UK consumer law, consumers generally have a 30-day short-term right to reject goods that do not conform to the contract and obtain a refund, subject to the relevant legal conditions.
After the short-term right to reject has expired, you may have rights to a repair or replacement and, where the relevant legal conditions are met, a price reduction or final right to reject the goods.
Any manufacturer's or Sweyn Forkbeard guarantee provided with a product is additional to, and does not replace, your statutory rights.
We will bear reasonable return costs where goods are being returned because they are faulty, damaged when delivered, incorrect or otherwise fail to conform to the contract.
Normal wear and tear, accidental damage, misuse, failure to follow instructions, or damage caused by using a product for a purpose for which it was not intended is not considered a manufacturing defect.
19. Items Damaged in Transit
If your order arrives visibly damaged, please contact us as soon as reasonably possible and provide your order details together with photographs where possible.
We may ask you to retain the packaging and damaged product while we investigate the matter with the delivery carrier.
Any request that you contact us promptly is intended to allow us to investigate the delivery and does not remove your statutory consumer rights.
20. Incorrect or Missing Items
If we send you an incorrect product or an item is missing from your order, please contact us as soon as reasonably possible.
Where we have made an error, we will arrange an appropriate remedy, which may include sending the correct product, replacing the missing item, or issuing a refund.
We will bear reasonable return costs for goods sent to you incorrectly.
21. Change-of-Mind Returns Outside Statutory Rights
From time to time, we may offer a voluntary returns policy that provides rights in addition to your statutory rights.
Any voluntary return, exchange or goodwill policy is subject to the conditions stated in our Return & Refund Policy at the time of purchase.
Nothing in a voluntary returns policy limits your statutory rights relating to faulty, misdescribed or non-conforming goods.
22. Intellectual Property
The Sweyn Forkbeard name, branding, trademarks, product presentation, Website content, photographs, graphics, artwork, text, videos and other intellectual property belong to Futuglobe Ltd or are used by us with permission.
You may access and use the Website for your personal, non-commercial shopping purposes.
You may not reproduce, modify, copy, commercially exploit, distribute or republish our Website content without our prior written permission except where permitted by law.
23. Third-Party Websites and Services
Our Website may contain links to websites or services operated by third parties.
We do not control third-party websites and are not responsible for their content, availability, privacy practices or terms.
Third-party payment providers, delivery companies and other service providers may operate under their own terms and privacy policies.
24. Privacy and Communications
We process personal information in accordance with our Privacy Policy and applicable data-protection law.
When you place an order, we may communicate with you electronically about your purchase, including sending order confirmations, payment information, dispatch notifications, delivery updates and customer-service communications.

25. Our Responsibility to You
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.
If we breach these Terms, we are responsible for losses that are a foreseeable consequence of our breach.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
If you are purchasing as a consumer, we are not responsible for business losses such as loss of profits, revenue, business opportunities or commercial goodwill arising from use of products purchased principally for personal use.
Nothing in this section affects your statutory consumer rights.
26. Events Outside Our Reasonable Control
We will not be responsible for delays or failures caused by circumstances outside our reasonable control.
These may include severe weather, natural disasters, transport disruption, postal or courier disruption, industrial disputes, governmental action, customs delays, war, terrorism, epidemics, failures of telecommunications or payment networks, or other events that we could not reasonably prevent.
Where such an event affects your order, we will take reasonable steps to minimise the effect and keep you informed where appropriate.
Your statutory rights relating to delivery and cancellation remain unaffected.
27. Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes in our business, Website, products, payment methods, delivery arrangements or applicable law.
The Terms & Conditions applicable to your order will normally be those in force when you place the order.
Where a change is required by law, it may apply as legally required.
28. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision will be treated as separated from the remaining provisions to the extent necessary.
The remainder of the Terms & Conditions will continue to apply.
29. Waiver
If we do not immediately enforce a right or remedy under these Terms & Conditions, this does not mean that we have waived that right or remedy.
30. Governing Law and Jurisdiction
These Terms & Conditions and contracts formed through our Website are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you.
If you are a consumer resident in another part of the United Kingdom or another country, you may also benefit from mandatory consumer rights and jurisdiction protections applicable where you live.
Nothing in these Terms & Conditions is intended to deprive a consumer of rights that cannot lawfully be excluded by agreement.
